We here at WiseDane Kennels  hereinafter referred to as the "seller" now enters into a contract with

Purchase the puppy is for the amount of   $                        consisting of a $                       NON-REFUNDABLE

Payment of the puppy must be paid in full before the puppy is released to the possession of the buyer no earlier than the

All sales are considered FINAL at time that seller receives the payment from the buyer. No cash/check/or money
order refunds will be allowed of any kind at any time. All payments made are NON-REFUNDABLE. Should buyer
opt not to purchase the puppy, all payments applied shall be transferred to another puppy of equal value on the
current or subsequent litters.

The seller agrees guarantees that the dane puppy has been well socialized with small and large dogs, cats, and children.

The seller agrees that if the buyer is buying the puppy on full registration, that with those full rights the buyer is at liberty to breed the puppy with his/hers own discretion without the pre-authorization of the seller.


Seller’s 2 Year Health Guarantee

NOTE: We will NEVER refund payment on a puppy. We will replace the puppy with one from a subsequent litter regarding Health Issues.

The Seller agrees to provide the following health warranty only: No other health warranty or guarantee is expressed or implied or is provided.

The Seller agrees that their health guarantee covers only the following genetic diseases/disorders:

·       Hip Dysplasia

·       Elbow Dysplasia

·       Megaesophagus

·       Wobbler’s Syndrome

·       Addison’s Disease

·       Cardiomyopathy

·       Hereditary Démodétic Mange

·       Entropion Eye (Surgical reimbursement up to $100 will be paid to vet performing the surgery.)

·       Umbilical Hernias (Surgical reimbursement up to $100 will be paid to vet performing the surgery at

                                   the time of spay/neuter surgery on limited rights puppies or before 24 months of

                                   age before the puppy breeds on full breeding rights puppies. )

The Seller agrees that if any of the above genetic diseases/disorders occur prior to the puppy turning the age of 24 months, the seller will replace the puppy with one of equal quality from the same or subsequent litters.

The Seller agrees to have the puppy wellness check done by a licensed veterinarian, a fecal examination with a negative result, and a state issued Health Certificate no earlier than 10 days prior to the puppy leaving to the buyers possession to confirm the health of the puppy.


HEALTH RELATED ISSUES NOT COVERED UNDER GENETIC HEALTH GUARANTEE

The Buyer agrees that the seller does not guarantee health problems arising from trauma, abuse or failure to maintain general health care of the dog. We do not guarantee against accidental death, environmental based problems, non-genetic issues, theft, or loss of dog due to anything other than what is stated in this health guarantee.

The Buyer agrees that this health guarantee does not include allergy or shedding issues, temperament or size issues, skin problems (such as acne or demodectic mange (non hereditary and environmentally based), HOD (Hypertrophic Osteodystrophy), PANO

(Panosteitis), OCD (Osteochondritis Dissecans), Bloat, Seizures, Viral or Bacterial Illnesses, Infections, Improper Bites, Ear Infections, Hernias (non umbilical), Hypoglycemia, Giardia, Coccidiosis, Worms or Parasites of any kind, any Illness due to the Ingestion of Foreign Objects, Food or Chemicals, Physical Injury or issues of Unknown Origin or that may have an environmental link, and Cherry Eye related to eye trauma.

The Buyer agrees that the seller does not guarantee the adult size or weight of the puppy once fully grown. The seller does their best with pairing adult females to males that will ensure that the puppy meets or exceeds breed standards but can not guarantee height or weight based on a pre-puberty assessment.

BUYERS RESPONSOBILITIES

Seller requires that their Kennel Name "WiseDane" be placed at the front of all puppy’s AKC Registration Name. The buyer will be allowed to choose the remaining registration names after the sellers Kennel Name. For example: WiseDane's Aidin the Needy v. Robberton. (In the example the Kennel Name appears and the buyer chose to name the dane "Aidin the Needy" and then chose to place their last name/kennel name at the end.)

The Buyer agrees that if they are to register the puppy with AKC that the WiseDane name be at the beginning of the puppy’s registration name when registering with AKC.

The Buyer agrees this puppy is being sold in good health, having determined so by visual inspection of the puppy. The puppy is in good weight and shows no signs of ill health or parasites.

The Buyer agrees to provide a safe environment for the puppy and that it will be protected from extreme heat and cold conditions, dangerous situations that could jeopardize the life of the puppy such as unfenced and unleashed straying, ability to get into poisonous substances, failure to vaccinate and de-worm properly and on time, failure to bath and clip nails regularly, failure to feed and maintain a healthy body weight, etc.

The Buyer agrees that the seller has provided accurate records of the puppy’s shots and de worming and agrees to administer the puppy’s vaccinations on a regular time according basis. (12 Weeks, 16 Weeks, 1 Year and each Year thereafter.)

The Buyer agrees to place puppy on a worming prevention to keep the dane healthy.

The Buyer agrees to seek medical treatment upon first detection of illness or major injury of the puppy.

The Buyer  agrees to have the puppy looked at by a veterinarian of their choice within 72 hours of taking possession of the puppy to verify it's health condition. Failure to do so will VOID the sellers health guarantee. If health problems are found, the puppy may be returned to the seller at the BUYERS EXPENSE, within the first 2 weeks of possession. Seller will replace the puppy with one of equal quality from the same or subsequent litters. Seller is not responsible for any veterinary expenses incurred by the buyer during the 72 hour health check.

The Buyer agrees that if they neglect to have pup examined within the allotted time, the seller assumes NO RESPONSIBILITY for any communicable disease or injury of the puppy; and that the health guarantee is null and voided and no exchange or return of the puppy in the future will be honored.

The Buyer agrees to maintain a receipt or health report of this initial evaluation until the puppy is 24 months of age to prove that the puppy underwent a health check within 72 hours of possession.

The Buyer agrees that should the buyer not maintain the initial puppy vaccination schedule, the seller IS NOT RESPONSIBLE for any communicable disease obtained in the pup’s future.

The Buyer agrees that should death of the puppy occur prior to two year of age, that a full necropsy shall be done by a licensed, state certified veterinarian and provided to the seller’s veterinarian for examination by the sellers veterinarian.

The Buyer agrees that any burying or cremation of the puppy prior to necropsy and the seller’s veterinarian’s examination of the necropsy report will VOID the sellers health guarantee and no replacement of the puppy will be granted.

The Buyer agrees that any burying or cremation of the puppy after the two year health guarantee has expired is permitted without necropsy.

The Buyer agrees that the seller will not reimburse any veterinarian charges at any time and that this is the sole responsibility of the buyer. The seller will ONLY REPLACE the puppy with one of equal quality from the same or subsequent litters.

The Buyer agrees that prior to replacement of puppy; they will provide all health records showing the puppy has received the appropriate care/vaccinations/deworming mentioned above, along with a written diagnosis from a licensed veterinarian, specifically describing which disease has been diagnosed and how the diagnosis was confirmed. *** The seller reserves the right to request any information on treatments that are available from the buyers veterinarian.***

The Buyer agrees to send a copy of all requested veterinarian reports, findings and test results to the seller via US mail to the address at the top of the contract, postmarked no later than 7 days from the date requested or the health guarantee will be considered null and VOID.

The Buyer agrees that should dysplasia be diagnosed by their vet, that they will have the dog’s hips and elbows radiographed and sent to the Orthopedic Foundation for Animals (OFA) in Columbia, Missouri, for evaluation and official diagnosis. *** Upon official OFA diagnosis the seller will ONLY REPLACE the puppy with one of equal quality from the same or subsequent litters. ***

The Buyer agrees that should thyroid, eye or heart disease be diagnosed by their vet, that they will have the dog’s thyroid level done, eyes evaluated, or heart cardiographed and sent to the Orthopedic Foundation for Animals (OFA) in Columbia, Missouri, for evaluation and official diagnosis. *** Upon official OFA diagnosis the seller will ONLY REPLACE the puppy with one of equal quality from the same or subsequent litters. ***

The Buyer agrees that upon receipt, a copy of the evaluation will be sent to seller. If hip or elbow dysplasia is diagnosed due to genetic defect (not environmental), or any other genetic disease/disorder mentioned above covered under our health guarantee, and all prerequisites have been met for the health and well being of the puppy as specified above, seller will replace the puppy with one of equal quality from the same or subsequent litters. ***The buyer may elect to do PRELIMS on a puppy at 1 year of age and send those into the OFA. Replacement of puppy with one of equal quality from the same or subsequent litters will be given at this time, if the Orthopedic Foundation for Animals deems at prelims, that the puppy will not pass at 24 months. ***

The Buyer agrees that instead of a replacement puppy, the seller may elect to have a small genetic problem fixed when possible on their current puppy, and the seller WILL REIMBURSE the buyer for expenses up to a maximum of $300.00 after receiving the original bill from a licensed veterinarian. Additional expenses are the buyer’s sole responsibility. ***The choice of a replacement puppy or $300 reimbursement will be left up to the seller’s discretion. Such things as Entropion Eye or Umbilical Hernias are a simple inexpensive corrective surgery that will not harm the life of the current puppy, and typically can be done at the same time as a spay/neuter on a limited rights puppy.  In the instance that a surgical procedure CAN NOT fix an issue, then the seller will ONLY REPLACE the puppy with one of equal quality from the same or subsequent litters. ***

The Buyer agrees should a genetic disorder be discovered later in life than 30 months of age, the seller will not provide any type of replacement on the puppy.


STRICT RETURN POLICY

In ALL cases we except all of our babies back in our care for re-homing regardless of the reason of return. Be it illness of the puppy itself, illness of the owner of the puppy, family illness of the owner of the puppy, death of the owner or a family member of the owner, financial hardship, deployment or base relocation (PCS), etc. We place the burden of interviewing and placing the puppy in a new home on ourselves versus the owner having to stress about the re-homing.

It's on RARE occasions that one of our danes cannot be kept by the buyer and must come back to us because of reasons no fault of the puppy themselves. The Buyer MUST RETURN the dane back to WiseDane at the buyers expense without exception.

The Buyer agrees to never co-own this puppy out, trade, give away, re-home, or re-sale this puppy at any time without the written consent of WiseDane and/or Bradley or Tiffany Wiseman.

The Buyer agrees to never enter the puppy into an animal shelter, rescue, and/or control department/bureau and that they will return the puppy to WiseDane at the buyers expense should the buyer not be able to keep the puppy in the future. *** Puppy may reside in an outside buyer’s home for no more than 3 weeks at a time, and must be returned back to the buyers home after that time frame and can not reside with another owner in a permanent status defined as over 3 weeks. ***

The Buyer agrees if the puppy can not be kept by the buyer in the future that they agree to return the puppy to the seller at their (buyers) expense. All fees and shipping expenses will be the sole responsibility of the buyer.

The Buyer agrees that upon return of the puppy to Wisedane they will receive NO REFUND or EXCHANGE and that they are forfeiting any rights to the puppy in the future.

The Buyer agrees to return all registration and documentation materials at the time of the puppy’s return. NON return of papers will result in a $200 re-papering fee billed to the buyer.

The Buyer agrees that if any of the contract is breached/broken and Wisedane has to reclaim the puppy through legal ramifications, that such legal ramification

§         Shall be utilized through arbitration versus court judge.

§         Shall take place in the state of Kentucky, County of Bullitt.

§          All court, filing, attorney fees and loss of wages for time to take care of this matter

§          associated with bringing and defending such litigation shall wholly and exclusively the  

§         responsibility of the buyer to reimburse inside of any judgment/action in  Wisedanes favor.                          

Limited Registration Versus FULL Registration with Breeding Rights

We value our lines and reputation that we have strived to build, and therefore our puppies go out on spay/neuter contracts unless we pre-approve you for a breeding home.

For LIMITED REGISTRATION

The Buyer agrees  that they must submit verification of spay/neuter by the age of 24 months in order to avoid VOIDING this contract and our health grantee.


For FULL REGISTRATION

The Buyer agrees that a female puppy on FULL REGISTRATION must reach at least 18-24 months of age prior to breeding.

The Buyer agrees that a male puppy on FULL REGISTRATION must be 12 months of age at time of breeding.

The Buyer agrees that a female puppy can not whelp more than five (5) litters and then must be spayed or this will null and VOID this contract and WiseDane can and will recover the female via arbitration and/or court judge at buyers expense.

The Buyer agrees that a male puppy must be neutered and no longer bred by the age of eight (8) years or this will null and VOID this contract and WiseDane can and will recover the male via arbitration and/or court judge at buyers expense. *** Male puppies may sire an unlimited amount of litters, but must be DNA’d with AKC after five (5) litters per AKC regulations. ***

Deposit & Payments

All of our puppy’s require a NON-REFUNDABLE deposit. This means if for any reason you place the puppy on HOLD and we STOP advertising it, assuming you will follow through with purchasing the puppy, and then you decide NOT to purchase the puppy for ANY reason (death, financial, personal, etc.) you will not receive a refund on your deposit.

The Buyer agrees that All sales are considered FINAL at time that seller receives the payment from the buyer. No cash/check/or money order refunds will be allowed of any kind at any time. All payments made are NON-REFUNDABLE. Should buyer opt not to purchase the puppy, all payments applied shall be forfeited or in some instances transferred to another puppy of equal value on the current or subsequent litters.

If for any reason we, WiseDane, can not fulfill the puppy purchase, for example; un-expected death of the puppy,  personal reasons, medical reasons, etc. WE WILL refund ALL payments made on the puppy AS WELL AS REFUND the deposit.
